**CJP Qazi Faez Isa Questions Issuance of Clarification by Judges Without Case File**

*By Sohail Khan | October 20, 2024*

Chief Justice of Pakistan (CJP) Qazi Faez Isa has expressed concern for the second time over a clarification issued by eight Supreme Court judges regarding the reserved seats case.

The clarification, which asserts that amendments to the Elections Act 2017 cannot override the court's July 12 judgment, has raised questions from the top judge. According to *The News*, CJP Isa on Saturday sought explanations on how this clarification was issued without the original case file being submitted.

The eight-judge bench, including Justice Syed Mansoor Ali Shah, Justice Munib Akhtar, Justice Muhammad Ali Mazhar, Justice Ayesha A. Malik, Justice Athar Minallah, Justice Syed Hasan Azhar Rizvi, Justice Shahid Waheed, and Justice Irfan Saadat Khan, held that the amendments cannot retrospectively undo the judgment. They emphasized that the Election Commission of Pakistan (ECP) must implement the judgment as required by Article 189 of the Constitution.

CJP Isa has called upon Deputy Registrar Mujahid Mahmood, Assistant Registrar Shahid Habib, and Webmaster Asim Javed for explanations. He also questioned how the clarification was uploaded to the Supreme Court's website without the proper case file being submitted.

As of the filing of this report, the Public Relations Department of the apex court had not issued any official press release regarding the matter.
